This privacy policy applies to all e-commerce sites operated by Welkit sarl, including, but not limited to, welkit.com, welkit-planet.fr, welkit-admin.com, welkit.be, welkit.ch, welkit.de, welkit.it, welkit.es, welkit.nl, welkit.pl, welkit.com, etc.

ARTICLE 1 - PURPOSE

Welkit places particular importance on respecting the privacy of users and the confidentiality of their personal data and is committed to processing data in compliance with applicable laws and regulations, notably Law No. 78-17 of January 6, 1978, relating to information technology, files, and freedoms (hereinafter referred to as the “Information Technology and Freedoms Law”), and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the “GDPR”).

As part of its commercial activity, Welkit is required to collect and process the personal data of its users (hereinafter referred to as the “Users”).

This privacy policy, established by Welkit, aims to provide users with synthetic and comprehensive information on the processing of personal data operated by Welkit.

ARTICLE 3 - DEFINITIONS

3.1 PERSONAL DATA

Personal data means any information relating to an identified or identifiable natural person, i.e., who can be identified, directly or indirectly, by reference to an identification number or to one or more factors specific to them.

Processing of personal data: constitutes a processing of personal data any operation or set of operations which is performed on such data, whatever the means used, and in particular the collection, recording, organization, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, erasure, or destruction.

3.2 COOKIE

A cookie is information placed on the hard drive of an internet user by the server of the site they are visiting. It contains several pieces of data: the name of the server that deposited it, an identifier in the form of a unique number, possibly an expiration date. These pieces of information are sometimes stored on the computer in a simple text file which a server accesses to read and record information.

3.4 DATA COLLECTED

Welkit collects data from Users to make available to them the services for which they have subscribed to the platform.

The mandatory or optional nature of the data filled in (to finalize the User's registration and provide them with Welkit's offers and services) is indicated during collection by an asterisk.

Furthermore, some data are collected automatically due to the User's actions on the site (see the paragraph on cookies).

3.5 PURPOSES

The personal data collected by Welkit in the course of providing services are necessary for the execution of contracts concluded with the User, or to allow Welkit to pursue its legitimate interests while respecting the User's rights. Some data may also be processed based on the User’s consent.

  • The purposes for which Welkit processes the data are as follows,
  • commercial and accounting management of the contract,
  • management of activation and marketing activities,
  • detection of malicious behavior (fraud, phishing, spam, etc.),
  • improvement of the users’ journey on the site,
  • more generally, any purpose referred to in Article 2 of Deliberation No. 2012-209 of June 21, 2012, establishing a simplified standard concerning automated processing of personal data relating to the management of users and prospects.

ARTICLE 4 - RECIPIENT OF THE DATA

The personal data collected are intended for Welkit's commercial and accounting services. They may be transmitted to Welkit's subsidiaries or to subcontracting companies which Welkit may call upon in the context of the execution of its services.

In this context, personal data may be subject to a transfer to a member country or not of the European Union. Welkit implements guarantees ensuring the protection and security of these data, in compliance with the regulation.

Welkit does not sell or rent personal data to third parties for marketing purposes.

However, the disclosure of personal data to third parties may occur in the following cases:

  • with their authorization;
  • at the request of legally competent authorities, upon judicial requisition, or in the context of a judicial dispute.

ARTICLE 5 - DATA RETENTION PERIOD

To meet its legal obligations or to have the necessary elements to assert its rights, Welkit may archive the data under the conditions provided for by the regulation.

Thus, the personal data collected by Welkit relating to the identity and contact details of its Users are archived for a maximum period of ten years after the end of the contractual relationships for User clients, or from their collection by the data controller or the last contact from the prospect User for data relating to them.

The end of the contractual relationships is understood as the express termination of the contract by the User.

ARTICLE 6 - USER RIGHTS

In accordance with the regulation, the User has the right to access and rectify data concerning them, which allows them to rectify, complete, update, or erase data that are inaccurate, incomplete, ambiguous, outdated, or whose collection, use, communication, or storage is prohibited.

The User also has the right to request the limitation of processing, and to object for legitimate reasons to the processing of their personal data. The User may also communicate directives regarding the fate of their personal data in the event of death.

Where applicable, the User may request the portability of their data, or, when the legal basis for processing is consent, withdraw their consent at any time.

The User can also at any time modify the data concerning them by clicking on the link Cookie management.

The User can unsubscribe from Welkit's newsletter or marketing emails by following the unsubscribe links in each of these emails.

In the event of a dispute, the User can file a complaint with the CNIL, whose contact details are available on the website www.cnil.fr.

The User can access detailed information on the use of their personal data, in particular regarding the purposes of the processing, the legal bases allowing Welkit to process the data, their retention periods, their recipients and, where applicable, the transfers of such data to a country not a member of the European Union as well as the guarantees implemented. ARTICLE 7 - COOKIES

Welkit's site uses cookies whose purpose is to facilitate navigation on the site, to execute the service provided by Welkit, to measure the audience of the site or even to allow the sharing of pages of the site.

7.1 TYPES OF COOKIES USED

7.1.1 Cookies necessary for navigation on the site

These cookies are necessary for the operation of the Welkit.com site. They allow the use of the main features of the site. Without these cookies, Users cannot use the site normally.

7.1.2 Functional cookies

These cookies allow personalizing the User experience.

7.3 COOKIE LIFESPAN

Cookies are placed on the User's terminal for a maximum duration of 13 months from the User's consent.

After this period, consent will be collected again.

7.4 SECURITY

Welkit has taken all necessary precautions to preserve the security of personal data and, in particular, to prevent them from being distorted, damaged, or accessed by unauthorized third parties.

These measures include the following:

  • Multi-level firewalls,
  • Antivirus of recognized reputation and detection of intrusion attempts,
  • Encrypted data transmission using SSL/https/VPN technology,
  • Tier 3 and PCI DSS certified data centers
  • Moreover, access to treatments by Welkit services to the recipients requires authentication of the people accessing the data, through an access code and an individual password, sufficiently robust and regularly renewed.

Data traveling on unsecured communication channels are subject to technical measures aimed at making these data incomprehensible to any unauthorized person.

Welkit reserves the right to evolve this Privacy Policy to comply with changes in laws and regulations in force.
